How do I take legal action against my accountant whom I can't reach & nor return my calls. He didn't file my income taxes and has my business files. He has a PO box and I can't seem to know what to do at this point.

The accountant is not a CPA member, just a basic bookkeeper. He uses a UPS store post office box, if I were to take him to small claims, how would I serve him? Also, would he be liable for any damages due to the delays & hardship on my business because he has my files?

I will be using certified mail to take the first step.
