I moved from apartment 3/24/08 with proper notice to Middlesex Mgmt. I have a copy/receipt for returning my keys. MM claims they mailed my check certified on 4/30/08. The certified# they gave my does not come up in USPS system and I filed claim with the USPS also. As of 5/10/08, I still do not have security back. Under the NJ law, I can file in small claims court for twice the amount of my security which approx $2400.00. Should this be my next step after no results from talking to MM staff? Thank you

I think you are following the correct course of action. However, before you actually file in small claims court send a certified letter to MM letting them know your plan of action and how much you intend to sue them for. Also, give them a deadline to comply or you file suit. Sometimes, all you need to do is threaten legal action to get them to comply. If you do not hear from them by the deadline go ahead and file in small claims.
